1. Who these terms apply to
These terms apply to your use of the iLende apps for Apple devices (iPhone, iPad, Mac and Apple Watch) and for Android, and of the website and web map at ilende.no (together "iLende"). iLende is provided by Square Wave AS ("we"), a Norwegian company with company registration number 934 409 302. By downloading or using iLende you accept these terms. If you do not accept them, do not use iLende.
2. The free map and iLende Pro
The map is free in Norway, Sweden, Finland and Iceland, both in the app and on the website. In the app, 3D, search, huts and routes, waypoints on the device and your position are free too, and so are satellite and hybrid maps where we have imagery.
iLende Pro is a one-time in-app purchase, not a subscription. It includes offline maps (downloading areas, also to Apple Watch), turn-by-turn navigation, the measuring tool and waypoint sync between iPhone and iPad. In the apps for Apple devices the purchase follows your Apple Account: on a new device you restore it under Settings → About → Restore purchases in the app, and if you have received a code, you redeem it from the purchase screen in the app on iPhone and iPad, and in the App Store on a Mac. In the Android app the purchase follows your Google Account, and you redeem codes in Google Play. A purchase in the App Store applies in the apps for Apple devices, and a purchase in Google Play applies in the Android app; a purchase cannot be moved between the two stores.
iLende Pro is bought and billed through the App Store or Google Play, under the terms of the store you buy from. The store handles payment, refunds and the right of withdrawal under its terms, and you request a refund from the store that took the payment: Apple for purchases in the App Store and Google for purchases in Google Play. We do not take away features you have paid for in iLende Pro, and we do not turn them into a subscription.
3. Licence
The apps for Apple devices are licensed to you under Apple's standard end user licence agreement (Licensed Application End User License Agreement), and these terms come in addition. The Android app is licensed to you under these terms.
You get a personal, non-exclusive, non-transferable right to use the app on devices you own or control. You may not copy, modify, reverse engineer, resell or redistribute the software, the design of the map or our own content, beyond what the law allows.
The map data comes from open sources and is published under its own licences (see Map data and licences). These terms do not limit the rights you have under those licences.
4. Safety outdoors – please read
iLende is an aid for finding your way and planning. Maps, routes, calculated routes, directions, elevation data, satellite imagery and other information can be incomplete, out of date or wrong.
- Suggested routes do not take into account avalanche danger (check varsom.no in Norway and lavinprognoser.se in Sweden), closed roads and trails, seasonal restrictions such as nesting seasons, reindeer calving and national park rules, private land and the right to roam, glaciers, or crossing rivers and fjords. A route can lead through terrain that is dangerous or impassable.
- In Iceland the highland roads can be closed. Check safetravel.is before you go.
- Information about huts can be out of date. Check with whoever runs the hut, for example DNT, STF, Metsähallitus or Ferðafélag Íslands.
- The position from your phone and watch can be inaccurate, and batteries run down fast in the cold.
Never rely on a single source for navigation in the mountains. A phone can break or run out of battery, so always bring a paper map and compass on trips where that matters. Check the conditions before you go, and use your own judgement. You are responsible for your own safety and your own decisions.
iLende is not an emergency service. Call 112 in an emergency. In Norway you can also call 113 for medical emergencies. 112 also works in Sweden, Finland and Iceland.
5. Acceptable use
You must not misuse iLende, for example by trying to disrupt the service, gaining access by unauthorised means or using it unlawfully.
The map files on our file server are for use in iLende. You must not download them in bulk, scrape or systematically copy map tiles or catalogues, or create automated traffic that burdens the service. This does not limit your rights under the licences of the map data: you can get the data from its sources, and you can ask us for data derived from OpenStreetMap (see Map data and licences).
6. Disclaimer and limitation of liability
iLende is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. To the extent Norwegian law allows, Square Wave AS is not liable for indirect or consequential loss, or for loss arising from your use of, or inability to use, iLende. This limitation does not apply to personal injury, or where we have acted intentionally or with gross negligence. Nothing in these terms limits liability that cannot be limited under mandatory law, nor your rights as a consumer.
7. Apple and Google
These terms are between you and Square Wave AS, not between you and Apple. Apple has no obligation to maintain or support the app. Apple is not responsible for product warranties, for handling claims relating to the app (including product liability claims, legal or regulatory claims and intellectual property claims) or for refunds, which Apple handles under its own policies. Apple and Apple's subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
The Android app is distributed through Google Play. Google is not a party to these terms and has no obligation to maintain or support the Android app. Purchases in Google Play are subject to Google Play's terms.
8. Changes
We may update iLende and these terms. We give notice of material changes on this page and in the app's release notes before they take effect. Changes do not take away features you have paid for. If you do not accept the new terms, you can stop using iLende.
9. Governing law
These terms are governed by Norwegian law, and the Norwegian courts have jurisdiction. This does not limit the mandatory consumer protection you have in the country where you live. If you are a consumer, you can always bring a case before the courts where you live, and the choice of court does not bind you.
